An Overview of New Jersey Product Liability Law

Child Killed In New Jersey Turnpike Rollover Accident

An 8-year-old girl was killed in South Brunswick late last month, after she was ejected from a sport utility vehicle that flipped on the New Jersey Turnpike.

The fatal car accident occurred after the SUV's driver lost control of her vehicle and struck a barrier.

After the accident, the girl was transported by helicopter to Robert Wood Johnson University Hospital, where she was pronounced dead. Two other occupants suffered personal injury and were taken by ambulance to the same hospital.

New Jersey Worker Seriously Injured in Industrial Accident

A warehouse employee at a facility in South Brunswick was severely burned earlier this month when a chemical mixture he was working on exploded. He suffered first and second degree toxic chemical burns on about 25 percent of his body.

A New Jersey State Police helicopter transported the victim to Saint Barnabas Medical Center for treatment.

OSHA and South Brunswick Police are investigating the incident.

CPSC Provides Tools to Track Recalls of Dangerous Products

If you're like most New Jersey residents, you've probably received a letter at some point notifying you that a product you purchased has been recalled. Don't ignore it. Recalled products pose greater dangers than many people realize.

So far in April, 17 consumer products have been recalled by the Consumer Product Safety Commission. They include Office Depot desk chairs that may collapse upon sitting in them, Viking Range brand dishwashers that present risks of fire and burn injuries and a baby seat made by Todson's Topeak that can sever a child's fingertips. There were 20 more recalls made in March.

Children's Accidental Deaths Drop by 30 Percent

Some days, it seems like New Jersey parents are confronted with a cascade of news stories and warnings about possible threats to our children's safety. From unsafe toys and dangerous drugs to car accidents and sports injuries, the pressure to keep kids safe can sometimes feel overwhelming.

It appears, though, that this vigilance has paid off. According to the Centers for Disease Control and Prevention, accidental deaths among children and teens fell by 30 percent between 2000 and 2009.

Warm Spring Brings Risks to New Jersey Boaters

With an unusually warm spring upon us, many New Jersey residents are getting ready to spend some time out on the water.

However, it's important to note that even though the weather is warm, the water is not. Springtime boating accidents can easily lead to hypothermia and other serious injuries. In fact, in March 2010 alone, there were five New Jersey fatal accidents involving boaters who fell into cold water.

The risk of fatal accident is increased when a boat driver behaves negligently, for example by boating while intoxicated, going faster than the conditions warrant or attempting risky maneuvers or sharp turns.

Thousands Injured by Defective Metal-on-Metal Hip Implants

Just a few years ago, nearly one-third of American hip implant patients received all-metal implants. The implants, which use cobalt and chromium to recreate the hip's ball-and-socket joint, were designed to last longer than implants made from a combination of metal and plastic.

Unfortunately, in many patients, the implants seem to be doing more harm than good.

So far, more than 5,000 recipients have filed lawsuits alleging that the implants are defective medical devices. The largest manufacturer, Johnson & Johnson's DePuy, recalled its implants in 2010.

Investigators Blame Risk-Taking in New Jersey Plane Crash

More than two years after a Monmouth County plane crash killed five people, federal investigators have released a report blaming the accident on the pilot's decision to undertake risky maneuvers.

Investigators from the National Transportation Safety Board say the New Jersey fatal accident occurred after the pilot neglected to abide by the aircraft's operating limitations. His actions caused an overload failure of the plane's right wing.
